PRIMARY RESPONSIBILITIES:

The Contracts Manager will support the client organisation in the preparation and management of both customer and supplier contracts. The role will include active participation in management of contract changes and claims arising from delivery of contract scope.

SECONDARY RESPONSIBILITIES:

Support the client team in the commercial interpretation and clarifications of certain contractual documents

o

Requirements management: support in the clarification of interpretation from a commercial perspective of contractual obligations (for the client), support the client in following up their fulfillment, work with client to support their aim of ensuring that no additional work/expense beyond contractual obligations is engaged without appropriate identification, approval, monitoring and control

o

Assist Senior Project Managers (SPM) in the management of its respective scope with the perspective of:

o

Seeking to ensure that the clients entitlements are identified, preserved and enforced.

o

Seeking to ensure the managing and minimizing of the client’s contractual risks, and maximizing contact opportunities.

o

Contract change management: support the definition for the whole project (Customer, sub suppliers), of the contract change policy and related internal process, and support in maintaining an overall view on these changes

o

Coordinate the preparation and negotiate, with Senior Project Manager or Project Manager, the contract changes related to upstream Contract, and participate in significant changes with suppliers and subcontractors

o

Claim management: support the definition, for the whole project (Customer, Consortium, sub suppliers), of the claim policy and related internal process, and support in maintaining an overall view on these claims; support the preparation, submission and pursuit of claims (with Senior Project Manager and/or Project Managers and/or Procurement) against third parties and support the client in defending against claims received from third parties them.

Support in the writing or validation of correspondence or other documents being sent to third parties if they are contract-related or bear contractual stakes

o

With respect to sub-suppliers:

o

Together with and under the direction of the client’s Legal department, support Purchasing in preparing the standard conditions of purchase for the project.

o

Support the preparation of invitation to tender (if specific contractual matters) and the negotiation and evaluation of tenders (in particular in case of deviations to standard conditions of purchase)

o

Support the management of contracts with sub-suppliers, in particular when contract specific or significant subjects arise.

o

Support the management of claims and of major changes

o

Organize the passing of the effects of changes and claims to/from the Purchaser to/from the sub-supplier

o

Support the client in providing, maintaining and controlling contract documents throughout the project life

o

Support in the spreading

and maintaining of contract awareness among the project team

o

Support in the co-ordination of insurance claims

o

Support in the implementation of procedures for Target Price mechanisms

Qualifications:

At least 10 years experience in Contract Management.

Proven record of implementation of contract management practices on major projects.

Practical experience in the management of changes and claims.

Familiarity with UK contract standards including NEC.

Major construction, power and infrastructure projects.
